1. Introduction
These Terms of Service ("Terms") form a legally binding contract between you ("you", "User", "Subscriber") and Flow Momentum Limited ("Flow Momentum", "we", "us", "our"), a company registered in England and Wales.

By creating an account, subscribing to or using Flow Momentum, you agree to these Terms and to our Privacy Policy (at https://flowmomentum.ai/legal/privacy). If you do not agree, do not use the service.
2. How to Read These Terms (Housekeeping)
These Terms are drafted to be as clear and accessible as possible for individual Users while remaining legally precise. Headings and structure are provided for navigation. Where a term is defined, it is written in Capitalised form. References to statutes include any amendments or re-enactments. If any provision is held invalid, the remainder continues in force (see Section 15).
Current pricing, trial conditions, promotional offers and detailed feature descriptions are published on our website at https://flowmomentum.ai and, where applicable, in your Stripe Customer Portal. Those pages form part of the commercial relationship but are not incorporated into these Terms, so that we can evolve the product and pricing without republishing this document. These Terms govern the legal framework of your subscription regardless of tier, price or feature set in effect at the time of purchase.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a contract to use Flow Momentum. By creating an account, you confirm that you meet these requirements.
Flow Momentum is primarily intended for users in the United Kingdom, the European Economic Area and Switzerland, but is available worldwide subject to local laws. If you use the service from outside these regions, you are responsible for compliance with your local laws.
4. The Service
Flow Momentum is an AI-powered leadership and performance platform. The service provides conversational AI assistance for personal performance, communication and leadership-related tasks, along with supporting features such as user profile learning, optional third-party integrations (including Garmin) and subscription management.
The exact set of features, AI assistants, interfaces, integrations and limits may evolve over time. Current functionality is described on the website and within the app.
Flow Momentum is a coaching and productivity tool. It is not a medical device, medical or clinical decision support, psychological therapy, legal advice, tax advice or an HR/performance management system. See Sections 8 and 9.
5. Subscription, Trial, Payments and Cancellation
5.1 Subscriptions
Flow Momentum is offered as a paid subscription service. Current tiers, prices and billing intervals are shown on the website and in the checkout flow operated by Stripe Payments UK Ltd., which acts as our payment processor. All prices are shown in the applicable currency and exclusive of VAT where applicable; VAT is added at checkout based on your billing country.
5.2 Free trial
From time to time Flow Momentum offers a free trial period for new subscribers. The length of the trial (for example, 14 or 30 days) is shown at checkout. During the free trial you will not be charged. You can cancel at any time during the trial without incurring any fee. If you do not cancel before the trial ends, your subscription automatically converts to paid and is billed on the day the trial ends.
5.3 Billing cycle and renewal
Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected) unless you cancel. You can cancel at any time via Settings → Billing or via the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period, and you retain access until that date.
5.4 14-day right of withdrawal and the role of the free trial
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (UK) and Directive 2011/83/EU (EU), consumers ordinarily have a 14-day right to withdraw from distance contracts.
Flow Momentum's free trial is designed to give you more time than the statutory cooling-off period to test the full functionality of the service at no cost. Because the free trial period is at least 14 days and typically longer, and because your first payment is only taken after the free trial ends, the statutory cooling-off period expires inside the free trial window, before any payment is made. By continuing into a paid subscription after the free trial, you confirm that you have had the opportunity to test the service and wish to proceed.
As a result, paid subscription fees are non-refundable after the free trial converts to paid, except where a refund is required by law. You can still cancel at any time; cancellation stops future renewals but does not entitle you to a refund of fees already paid for the current period.
5.5 Price changes
We may change prices with at least 30 days' notice by email to active subscribers. New prices apply at the next renewal after the notice period. If you do not agree to the new price, you can cancel before the renewal date and the old price will apply until the end of your current billing period.
5.6 Taxes
You are responsible for any taxes (other than VAT charged through Stripe) applicable to your use of the service under your local law. Business users may provide a valid VAT ID at checkout for reverse-charge treatment where applicable.
5.7 Failed payments
If a payment fails, we may retry the charge for a reasonable period. If payment still fails, your subscription may be suspended until payment succeeds.
6. Account Registration and Security
You must provide accurate information when creating an account. You are responsible for keeping your credentials confidential and for all activity under your account. You must notify us at compliance@flowmomentum.ai if you suspect unauthorised use. We may suspend or terminate accounts that violate these Terms (see Section 12).
7. Your Content and Licence
7.1 Ownership
You retain all ownership rights to the content you create, upload, paste or generate through Flow Momentum, including your conversations, notes, uploads and automatically-learned profile ("User Wiki").
7.2 Licence granted to Flow Momentum
You grant Flow Momentum a limited, non-exclusive, worldwide licence to process your content solely to: deliver and operate the service; perform AI processing on your behalf; back up, restore and secure data; and improve service quality in aggregated, de-identified form. We do not train AI models on your content, do not share your content with advertisers, and do not sell your data.
7.3 Third-party data
When you enter information about colleagues, team members or other identifiable individuals, you are responsible for ensuring you have an appropriate legal basis to process that information. In respect of such third-party data, Flow Momentum acts as your processor and you are the controller. See the Privacy Policy for details.
7.4 Prohibited content
You may not use Flow Momentum to input, generate, store or transmit content that is: illegal under UK, EU or your local law; defamatory, harassing, discriminatory, hateful or threatening; sexually explicit content involving minors (zero tolerance); infringing on intellectual property; malicious code; or used to reverse-engineer or build a competing AI product.
8. Acceptable Use
You agree not to:
- use Flow Momentum in ways that violate the law or these Terms
- attempt to circumvent rate limits, security measures or access restrictions
- reverse engineer, decompile, scrape or mass-extract outputs from the service
- use automated means (bots, scripts) to access the service except via official APIs, if offered
- resell, sublicense or commercially exploit the service without our written permission
- use the service to spam, phish or send unsolicited communications to third parties
- impersonate another person or misrepresent your affiliation
- use Flow Momentum for any of the restricted use cases set out in Section 9
Violation may lead to suspension or termination of your account (Section 12).
9. Restricted Use Cases (EU AI Act Compliance)
Flow Momentum is operated as a Limited Risk AI system within the meaning of Article 50 of the EU AI Act, with transparency obligations only. To preserve this classification, you agree not to use the service for any use case that would bring it within the scope of Annex III High Risk categories of the EU AI Act, in particular:
9.1 Employment and workers' management (Annex III, point 4)
You will not use Flow Momentum, or any AI assistant provided by Flow Momentum, to make or materially support decisions on: recruitment, hiring, CV screening or candidate evaluation; promotion, demotion, termination or disciplinary action; formal performance appraisals entered into HR systems; allocation of tasks, monitoring or evaluation of employee performance; or compensation and career progression.
Flow Momentum may be used as a personal thinking and preparation tool (for example to help you prepare for a meeting or reflect on a conversation). The outputs are your own thoughts and drafts. You remain solely responsible for any HR action you take, and for ensuring that the decision process complies with applicable employment law and AI regulation.
9.2 Medical, clinical and psychological use
You will not use Flow Momentum to diagnose medical conditions, to prescribe or change medical treatment, to replace consultation with a qualified healthcare professional, or as psychological therapy. Athletic and health-related outputs are coaching insights only.
9.3 Other restricted categories
You will not use Flow Momentum for credit scoring, insurance underwriting, law enforcement, border control, migration, justice administration, or any other use case listed in Annex III of the EU AI Act or otherwise classified as High Risk by applicable law.
9.4 Technical safeguards
Our AI assistants are configured with system instructions intended to decline requests for these restricted use cases. Users may be asked to acknowledge this restriction when first using features where the risk is most relevant. These safeguards complement — they do not replace — the contractual restriction in this Section 9.
9.5 Consequences of breach
If we reasonably believe you are using Flow Momentum for a restricted use case, we may: warn you; suspend specific features; suspend your account; and/or terminate the subscription in accordance with Section 12. Fees already paid are not refundable in case of termination for breach of this Section.
10. AI Transparency and Limitations
Under Article 50 of the EU AI Act, you are hereby informed:
- You are interacting with an AI system, not a human.
- Outputs are generated by language models and are not the opinion, recommendation, or professional advice of a licensed coach, medical professional, therapist, lawyer, tax advisor or HR specialist.
- AI can make mistakes, generate inaccurate information ("hallucinate"), be outdated, or misinterpret your input.
- Always verify safety-critical, medical, legally sensitive or financially significant outputs with a qualified professional.
- Flow Momentum makes no guarantee of specific athletic, leadership, business or personal outcomes. You use the service at your own judgement and risk.
11. Intellectual Property
Flow Momentum and all associated software, designs, logos, trade marks, text, graphics and content (excluding your user content) are owned by Flow Momentum Limited or its licensors and are protected by UK and international intellectual property laws. If you submit suggestions or feedback, you grant us a royalty-free, perpetual, irrevocable licence to use them without compensation. Third-party libraries and services (including Anthropic Claude, Mistral, OpenAI Whisper, ElevenLabs and Stripe) are the property of their respective owners and subject to their own terms.
12. Data Protection
Processing of personal data is governed by our Privacy Policy at https://flowmomentum.ai/legal/privacy, which is incorporated by reference into these Terms. The Privacy Policy explains the categories of data processed, legal bases, third-party processors, international transfers, retention periods, your rights and how to exercise them.
13. Suspension and Termination
13.1 Termination by you
You may cancel your subscription at any time via Settings → Billing or the Stripe Customer Portal. You may also delete your account entirely via Settings → Privacy → Delete Account, which triggers full erasure in accordance with the Privacy Policy.
13.2 Termination by us
We may suspend or terminate your account with or without notice if you materially breach these Terms, use the service for restricted purposes (Sections 8 or 9), fail to pay subscription fees, expose us to legal, reputational or security risk, or where required by law or regulatory authority. For non-material breaches, we will use reasonable efforts to notify you and allow a reasonable period to cure before termination.
13.3 Effect of termination
On termination your access ends, your data is deleted or retained per the retention schedule in the Privacy Policy, and you remain liable for any fees accrued before termination. Provisions which by their nature should survive termination do so, including Sections 7, 9, 10, 11, 14 and 15.
14. Limitation of Liability
14.1 Nothing excluded by law
Nothing in these Terms limits or excludes liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability which cannot lawfully be excluded under the Consumer Rights Act 2015, the Unfair Contract Terms Act 1977, UK GDPR, EU GDPR or other applicable mandatory law.
14.2 Liability cap
Subject to Section 14.1, Flow Momentum's total aggregate liability to you in connection with these Terms is limited to the greater of: (a) the total amount you paid Flow Momentum in the 12 months preceding the event giving rise to the claim; or (b) £100.
14.3 Excluded losses
Subject to Section 14.1, Flow Momentum is not liable for indirect, consequential, incidental, special or punitive damages; loss of profit, revenue, business, goodwill, data (beyond statutory data rights) or opportunity; damages arising from your reliance on AI output; damages arising from your misuse of the service for restricted purposes; or damages arising from third-party service outages (including Stripe, Anthropic, Mistral, Garmin) beyond our reasonable control.
14.4 Consumer rights preserved
If you are a consumer, your statutory rights under the Consumer Rights Act 2015 and equivalent EU consumer legislation are not affected by these Terms. In particular, you have the right to expect the service to be provided with reasonable care and skill.
15. Governing Law, Jurisdiction and Consumer Rights
15.1 Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales.
15.2 Jurisdiction
Subject to Section 15.3, you and Flow Momentum agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute.
15.3 EU consumer reservation (Rome I, Article 6)
If you are a consumer resident in an EU Member State, you also benefit from the mandatory consumer protection rules of your country of residence under Article 6 of the Rome I Regulation, and you may bring proceedings in the courts of your country of residence.
15.4 Complaints and alternative dispute resolution
Before starting legal proceedings, please contact us at compliance@flowmomentum.ai so we can try to resolve the issue. EU consumers can also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced by email to active subscribers at least 30 days before they take effect. Continued use of Flow Momentum after the effective date constitutes acceptance of the updated Terms. The current version is always available at https://flowmomentum.ai/legal/terms.
17. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and Flow Momentum concerning the service.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- No waiver. Our failure to enforce any right is not a waiver of that right.
- Assignment. You may not assign your rights without our consent. We may assign ours in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for failures caused by events beyond our reasonable control.
- Notices. Notices to Flow Momentum: compliance@flowmomentum.ai. Notices to you: the email associated with your account.
- Language. The English version of these Terms is the binding version. Any translation is provided for convenience only.
